(“Tote,” “we,” “us,” or “our”) including on our website available at https://tote.ai, Tote’s point of sale systems (“Tote AI POS”), and our other online or offline offerings that link to, or are otherwise subject to, this Privacy Policy (collectively, the “Services”).

Disclosure Regarding Merchant Data

This Privacy Policy does not apply to the personal information that we process on behalf of a customer who has contracted with Tote to provide the Services (“Merchant”). If you are a customer of a Merchant (an “End User”), the Merchant’s privacy policy governs the collection and use of your information. Questions or requests relating to your Merchant Data should be directed to the Merchant.

We may update this Privacy Policy from time to time in our sole discretion. If we do, we’ll notify you by posting the updated policy on our website, and we may also send other communications.

1. End Users of Tote AI POS

• Contact Information: name, phone number, email address, sex and age (to verify legal age for certain goods).

• AI Chat Agent: chat conversations may be recorded.
